The construction industry is a mainstay in Singapore. Construction disputes often arise from claims of delay or disruption of construction activities, disputed variations, and defective works. Having well-informed and experienced counsel can make a big difference in the outcome of your case.

We advise on construction disputes: acting in adjudication proceedings under the Building and Construction Industry Security of Payment Act (“SOPA”), claims and contested hearings before the courts, and arbitration proceedings. We have acted for owners, sub-contractors, contractors, consultants, and others involved in the construction industry.

Our lawyers are also familiar with all major standard forms used in Singapore (FIDIC, NEC, SIA, REDAS, PSSCOC), and have experience in the drafting of construction contracts for a wide range of residential, industrial and infrastructure projects.

Our experience includes:

  • Advised and acted for a global company in the offshore oil and gas industry in a multi-million dollar claim regarding a multi-million dollar dispute in relation to an Engineering, Procurement, Installation and Construction (“EPIC”) contract.

  • Assisted in representing a hydraulic engineering company in an SIAC arbitration in a dispute involving a contract for the design, supply, installation, testing and commissioning of hydraulic systems for a landmark local attraction.

  • Acted for specialised engineering company in a patent infringement claim and defending a patent revocation counterclaim.

  • Acted in claim against main contractor for unpaid fees for construction work, including adjudication proceedings under the Building And Construction Industry Security Of Payment Act (“SOPA”).

  • Advised on claims and termination of construction contract involving delay, liquidated damages, defects, and incomplete works.

  • Advised and acted for construction company in claims for breach of contract, defending claims alleging multiple defects and delay in completion.

  • Advised and acted for a property developer in a claim arising from breaches of contract and misrepresentation in relation to the sale of a property, and losses incurred due to consequent delays to redevelopment plans.

  • Acted for employers, main contractors and sub-contractors of various levels in adjudication proceedings under SOPA, involving issues such as defects, extension of time, acceleration and prolongation costs, and disputed variation orders.

  • Acted for a Grade A1 Singaporean contractor in an adjudication and thereafter an SIAC arbitration against a leading Malaysian property developer, involving claims of liquidated damages, disputed variation orders and wrongful certification by the project architect.

  • Advised a main contractor on complex issues arising out of a land reclamation project, involving the use of novel technology which posed challenges that fell outside the contemplation of the public sector standard form of construction contract.

  • Successfully secured >95% of a main contractor's claim against a subcontractor undergoing a multi-jurisdictional restructuring effort, overcoming a statutory moratorium under the COVID-19 (Temporary Measures) Act.

  • Advised leading digital infrastructure companies, as both external and in-house counsel, on the development of data centres across the Asia-Pacific region, including drafting and negotiating construction contracts, consultancy agreements, equipment purchase contracts and other supply agreements.

  • Retained to advise on all legal matters relating to the development of a luxury hotel in Singapore, seeing the matters from tender to a successful closure of final accounts on terms favourable to the client.
